1. Information Collection & Statutory Requirements

  • Notarial Acts (MA Executive Order 455): As Massachusetts Notaries Public, we are required by law to maintain a Notary Journal. This includes your name, address, signature, and the type of identification presented. These records are kept in a secure, locked location for the duration required by state law.
  • I-9 Verification: We process names, birth dates, and government-issued identification (Passports, Driver’s Licenses, SSNs) to complete Section 2 of Form I-9 as Authorized Representatives.
  • Remote Verification: For video calls, we view and may capture temporary images of documents solely for the purpose of uploading them to the employer’s secure portal (e.g., HireRight).

2. Professional Disclaimers (Legal Shield)

  • Non-Attorney Disclosure: BOSTON NEWTON NOTARY AND ITS AGENTS ARE NOT ATTORNEYS LICENSED TO PRACTICE LAW IN THE COMMONWEALTH OF MASSACHUSETTS. WE ARE NOT ALLOWED TO DRAFT LEGAL DOCUMENTS, GIVE ADVICE ON LEGAL MATTERS, INCLUDING IMMIGRATION, OR CHARGE A FEE FOR THOSE ACTIVITIES.
  • Service Distinction: Form I-9 verification is not a notarial act. When performing I-9 services, we act as designated “Authorized Representatives” or “Agents” of the Employer.
  • Employer Liability: The Employer—not the Authorized Representative—is legally and financially responsible for final I-9 compliance and the choice of verification method (including remote video).
  • Limitation of Liability: Our total liability for any error, omission, or service failure—including rejected I-9s or delayed start dates—is strictly limited to the service fee paid for the appointment. We are not liable for consequential damages or employer-level fines.

3. Fees & Reimbursements

  • Flat-Fee Structure: We generally charge a flat fee based on travel distance, time, technology requirements, and administrative costs. This fee is for the overall service provided and is distinct from the statutory fees for individual notarial signatures.
  • Reimbursement: Payment is due at the time of service regardless of whether the employer chooses to reimburse the employee.

4. Data Security & Third Parties

  • Zero-Storage Policy: For I-9 services, any digital copies or scans of IDs provided to us are permanently deleted immediately after a successful upload to the employer’s system.
  • Third-Party Platforms: We are not responsible for the data security, privacy practices, or technical failures of third-party platforms provided by an employer (e.g., HireRight, Workday, Zoom, Google).
